Thomas M. Carothers Estate Packet: 1862

Biographical Notes

Thomas M. Carothers was born during 1807 in Tennessee. He was the son of William (born 1795 Georgia) and Sarah (born 1792 Georgia) Carothers. Thomas Carothers married Mary Ann Stovall about 1832 in Alabama. Thomas brought his family to Itawamba County around 1839 where he settled in the Van Buren area on the Tombigbee River, where he was a merchant. However, by the 1860 Federal Census he had moved to the Campbellton area where he was listed as a merchant. He owned a boarding house, steam mill and blacksmith shop in Guntown on the Mobile and Ohio Railroad. The children of Thomas M. and Mary Ann Stovall Carothers were: William H. (born about 1833 in Alabama; died before 1860); Gilbert C. (born about 1838 in Alabama; died before 1860); John Stanley (born about 1839 in Itawamba County); Sarah Ann Elizabeth. (born about 1844 in Itawamba County); and Thomas H. (born about 1860 in Itawamba County). Thomas M. Carothers died in Guntown, Itawamba County on November 5, 1862.

Know all men by these presents that I am held and bound unto Wm. C. Thomas in the sum of Nineteen Hundred Dollars they payment whereof is will and truly to be made, and by these presents bind myself, my heirs and assigns to the due performance of the same. The conditions of the above bond are as follows: I have sold to the said W.C. Thomas a tract or parcel of land lying in Itawamba County in the State of Mississippi known as the SW 1/4 of Section 19 in Township 10, Range 8 East ... the title of which is now in C. Hussy and C.W. Taylor and is to be made to T.M. Carothers. Now if I the said Carothers shall cause to be made to the said W.C. Thomas, a good title to the above described land within the next twelve months the above bond to be void, otherwise to remain in full force.

Stovall ... shows that the personal estate and effects of said deceased are wholy insufficient to pay and satisfy the debts ...the said decedent, siezed and possessed of an undivided half interest in the following lands and premises lying and being in the county aforesaid to wit: all that portion of the SW 1/4 of Section 27 in Township 7, Range 6 east of the Mobile and Ohio Rail Road, containing 35 acres more or less, and the East half of Section 34, Township 7, Range 6 East containing ... the steam mill and appurtenances in Guntown, also a four acre lot in said town known as the Boarding House lot, with the buildings and improvements thereon... also 1 blacksmith shop in said town .... petitioner believes .... that a sale of said tracts and parcels of land will be necessary to pay and satisfy the debts of said decedent .... that said decedent left surviving him his wife Mary A. Carothers and three children to wit: John Stanley, Ann Eliza and Thomas H. Carothers, the later of whom are minors and with guardians of law...

The petition of G.W. Stovall ... would respectfully represent unto your honor that he has fully administered said estate as far as it is possible to do. That he has never collected any of the claims in favor of said estate except as reported in his final account above. That all of said notes and claims are worthless and could not be collected by suit or otherwise... he now asks an allowance of all said claims...that all the money received by this administration except for the sale of the 3 shares of the Mobile and Ohio Rail Road stock was in Confederate money and is wholly worthless...that the said estate being wholly insolvent it was impossible for him to use said money in the payment of debts of the estate. This administrator would further state and show unto your honor that there was one yoke of oxen belonging to said estate which he got an order of the Probate Court to sell to pay debts, but he never sold said oxen but the soldiers of the Confederate army came and possessed them and did not pay for them...that the following are the heirs and distributees of said estate with their residency: The widow, Mary Ann Carothers, John S. Carothers and Thos. H. Carothers who are adults and live in Monroe County, and Anna E. Hansel and her husband John Hansel, who are adults and reside in Lee County ...
